Terms of Service

1. Introduction
These Terms of Service ("Terms") govern your access to and use of PingGuard ("Service"), operated by PingGuard ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms.
If you do not agree to these Terms, do not use the Service. We reserve the right to update these Terms at any time. Continued use after changes constitutes acceptance.
2. Service Description
PingGuard is an uptime monitoring and status page platform. The Service includes:
- HTTP(S) endpoint monitoring from multiple geographic regions
- Quorum-based alert evaluation to minimize false positives
- Branded public status pages with custom subdomains
- Incident management with lifecycle tracking
- Alert notifications via email, Slack, and webhooks (plan-dependent)
3. Account Registration
To use the Service you must create an account. You agree to provide accurate information and keep it current. You are responsible for all activity under your account and for maintaining the security of your credentials.
You must be at least 18 years of age or the legal age of majority in your jurisdiction to create an account.
4. Acceptable Use
You agree not to use the Service to:
- Perform denial-of-service attacks or intentionally overload third-party infrastructure
- Monitor URLs you do not own or have authorization to monitor
- Circumvent rate limits or plan restrictions through technical means
- Distribute malware or use the Service for any unlawful purpose
- Resell, sublicense, or redistribute access to the Service without our written consent
We reserve the right to suspend or terminate accounts that violate these terms without notice.
5. Plans, Billing, and Refunds
PingGuard offers Free, Pro, and Business plans. Plan features and limits are described on our pricing page and are subject to change.
- Free plan: No payment required. Subject to usage limits (5 monitors, 5-minute check intervals, 7-day data retention).
- Paid plans: Billed monthly via Stripe. Your subscription renews automatically unless cancelled.
- Upgrades: Take effect immediately. You are charged the prorated difference for the remainder of the billing cycle.
- Downgrades: Take effect at the end of the current billing cycle. Excess monitors will be paused, not deleted.
- Cancellation: You may cancel at any time through the Stripe Customer Portal. Access continues until the end of the current billing period.
- Refunds: We offer pro-rated refunds for annual plans if requested within 14 days of purchase. Monthly plans are not eligible for refunds.
- Failed payments: If payment fails, we will retry for 3 days. After 3 days without successful payment, your account will be downgraded to the Free plan.
6. Data Handling
We take data handling seriously. Here is what we store and what we do not:
What we store:
- Your account information (email, name)
- Monitor configurations (URLs, expected status codes, headers)
- Check results (HTTP status codes, response times, up/down status)
- Incident records and status page configurations
What we do NOT store:
- HTTP response bodies from monitored endpoints
- Credentials or authentication tokens from monitored sites
- Personal data of visitors to your monitored sites

7. Data Retention
Raw check data is retained according to your plan tier:
- Free: 7 days raw checks, 30 days 5-minute aggregates, daily aggregates retained indefinitely
- Pro: 30 days raw checks, 90 days 5-minute aggregates, daily aggregates retained indefinitely
- Business: 90 days raw checks, 1 year 5-minute aggregates, daily aggregates retained indefinitely
8. Service Availability
We strive to provide a reliable service but do not guarantee 100% uptime for the monitoring platform itself. The Service is provided on a best-effort basis. We are not liable for any damages resulting from service interruptions, delayed alerts, or missed outage detections.
9. Account Termination and Deletion
You may delete your account at any time from the Settings page. Upon deletion:
- All monitors, checks, status pages, and incidents are permanently deleted
- Your Stripe subscription is cancelled immediately
- Your authentication account is revoked
- This action is irreversible
We may also terminate or suspend your account if you violate these Terms or if required by law.
10. Intellectual Property
The Service, including its design, code, and branding, is owned by PingGuard. You retain ownership of any data you submit to the Service. By using the Service, you grant us a limited license to process your data solely for the purpose of providing the Service.
11. Limitation of Liability
To the maximum extent permitted by law, PingGuard shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.
Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless PingGuard and its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
13. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
